EB-4  Religious Immigration

EB-4 religious immigration is an employment-based immigration based on potential job opportunities. The religious alien does not need to be working in the United States for the potential employer before and during the filing of Form I-360. Applicants must have 2 years of experience working in the same denomination, but these 2 years of work experience do not have to come from the potential employer. Although foreigners can apply for EB-4 religious immigration on their own, in most cases potential employers apply on their behalf.

​Application Conditions

When applying for EB-4 religious immigration, both the employer and the foreign employee must meet certain requirements. The Immigration Bureau will generally judge whether the employer is a genuine religious institution and whether the foreign national will truly perform religious duties after arriving in the United States:

  • The foreigner has been a member of the religious denomination he or she believes in within the last 2 years before applying for religious immigration.

  • The religious denominations to which foreigners belong have non-profit religious organizations in the United States, such as churches, temples, mosques, etc. Foreign nationals come to the United States to work in full-time, paid religious employment.

  • The foreigner has been a member of the religious denomination he or she believes in within the last 2 years before applying for religious immigration.

  • The real purpose of foreigners applying to come to the United States is to work for non-profit religious organizations in the United States or organizations affiliated with religious denominations in the United States.

  • The relevant work mentioned by the foreigner was performed by the applicant after he was 14 years old, and he had worked in the religious group for at least two consecutive years before submitting this visa application.

  • The real purpose of foreigners applying to come to the United States is to work for non-profit religious organizations in the United States or organizations affiliated with religious denominations in the United States.

  • The relevant work mentioned by the foreigner was performed by the applicant after he was 14 years old, and he had worked in the religious group for at least two consecutive years before submitting this visa application.
