EB-2 NIW National Interest Waiver

EB-2 NIW National Interest Waiver

National Interest Waiver (NIW), also known as high-skilled immigration, is a special case of the second preference (EB-2) for employment-based immigrants in the U.S. immigration law. Based on the consideration of national interests, the U.S. government provides foreigners who have made important contributions to the national interests of the United States with the opportunity to waive permanent work requirements and labor certification applications, so that they can apply directly to the Immigration Bureau for immigration and obtain a green card.

​Application Conditions

In their professional fields, applicants can meet at least six of the following eight application conditions:

  • Received national or above individual awards

  • Have membership in a national or above association

  • Personal interview with national media

  • Served as a judge or journal reviewer for national projects, competitions

  • Made unique and original important contributions in the industry, such as writing industry standards, invention patents being widely used, etc.

  • Publish at least 5 academic journal articles or books

  • Have held national or above works exhibitions or other display activities

  • Obtained more than one million commercial income through artistic performances or works

  • Requirements: A full-time master's degree or above. A full-time bachelor's degree requires at least 10 years of relevant experience in the field of study. Applicants are required to work in fields that are basically consistent with their major.
